Rule 14
Determination of number of posts on the basis of vacancy percentage
(1) According to Rule 13, after receiving the information regarding the demand for employees, the Public Service Commission will determine the number of posts based on the percentage of vacancies to be filled by open competition, evaluation of work ability, internal competitive examination and seniority and performance evaluation in accordance with Section 7 of the Act.
(2) When determining the number of posts in accordance with sub-rule (1), the number of posts to be filled by open competition in accordance with sub-section (1) of section 7 of the Act shall also determine the number of posts to be filled in accordance with sub-section (7) of the same section. (3) For the purposes of sub-section (7) of section 7 of the Act, the details of economically and socially backward women, tribal/tribes, Madheshi, Dalit communities shall be as prescribed by the Government of Nepal by publishing a notice in the Nepal Gazette. However, until notice is published in the Nepal Gazette, all women, tribals/tribes, Madheshis, Dalits will be considered economically and socially backward communities.
(4) In accordance with sub-section (7) of section 7 of the Act, when applying for the posts separated, it should be given on the following basis:-
(a) In the case of tribals/tribes listed in the Nepal Adivasi/Tribal Upliftment National Foundation Act, based on the same list, but if there is more than one surname within the caste listed in the Nepal Adivasi/Tribal Upliftment National Foundation Act, listed by the Chief District Officer on the recommendation of the head of the concerned local body. It should be certified as a surname within the caste and submitted along with the application.
(b) In the case of Dalits, based on the same list as in the case of the caste listed by the National Dalit Commission, but if there is more than one surname within the caste listed by the National Dalit Commission, on the recommendation of the head of the relevant local body, the chief district officer shall submit the application after certifying that it is a surname within the caste listed by the National Dalit Commission. > (c) In the case of disabled persons, on the basis of proof of disability from the Social Welfare Council on the recommendation of an approved physician,
(d) In the case of Madheshi, the institution as prescribed by the Government of Nepal by publishing a notice in the Nepal GazetteOn the basis of being certified as a Madhesi, but until the organization is designated after publishing a notice in the Nepal Gazette, the application must be certified as a Madhesi by the Chief District Officer upon the recommendation of the head of the local body concerned.
(e) In the case of backward areas, a certificate of citizenship obtained from the relevant district mentioning permanent residence in the district mentioned in sub-section (7) of section 7 of the Act and on the basis of proof from the relevant village development committee or municipality that he is currently residing permanently in the same place.
